Law Enforcement Authorities Fully Prepared to Implement New Criminal Code and Criminal Procedure Code

Jakarta – the Vice Minister of Law Edward O.S. Hiariej stated that Indonesia’s law enforcement authorities are fully prepared to implement the new Criminal Code (KUHP) and Criminal Procedure Code (KUHAP). He made the statement during a working meeting between the House of Representatives (DPR) and the Ministry of Law (Kemenkum) on Monday (19 January 2026).

According to the Vice Minister, this assertion is grounded in concrete developments on the ground. As an example, he pointed to the Corruption Eradication Commission (KPK), which has adjusted its procedures during recent sting operations.

“Just three days after the new KUHP and KUHAP came into force, the KPK conducted a sting operation and applied the new KUHAP by no longer displaying corruption suspects to the media. This is in line with the new KUHAP, which prohibits actions that undermine the presumption of innocence,” he said at the Parliament Complex in Senayan, Jakarta.

He added that prosecutors have also applied the new procedural framework in determining charges, referring to Articles 603 and 604 of the new KUHAP, which revoke Articles 2 and 3 of the Anti-Corruption Law.

“The KPK has adapted very quickly,” said Hiariej, who is widely known as Eddy.

The Vice Minister further noted that on 9 January 2026, the Muara Enim District Court issued a ruling based on the new Criminal Code by granting judicial pardon, a mechanism not recognized under the previous legal framework.

“In a case involving a minor who stole a cable and later returned it, the judge applied judicial pardon as provided under the new KUHP,” Eddy explained.

He also emphasized that extensive socialization and training for law enforcement officers have been carried out since 2025. The Supreme Court has conducted 11 training sessions, with up to 750 judges participating in a single session.

“Similarly, the Prosecutor’s Office and the National Police hold regular socialization programs every week,” he added.

Earlier in the meeting, Commission XIII of the DPR questioned the readiness of law enforcement authorities to implement the new KUHP and KUHAP. A representative from the Prosperous Justice Party (PKS) faction, Meity Rahmatia, stressed the need for comprehensive training.

“There are concerns about the potential for criminalization. We expect the Ministry of Law to oversee and ensure fair law enforcement. We also call for concrete measures in the form of large-scale training for law enforcement officers, the Supreme Court, the Police, and the Prosecutor’s Office to prevent misinterpretation of the new provisions,” Meity said.
